Giveaway Terms and Conditions

  1. Information on how to enter forms part of these terms of entry. Entry into every giveaway draw conducted by the Promoter is deemed acceptance of these terms and conditions.
  2. Entry is open to all residents of Australia except employees of the Promoter, its affiliates and agencies associated with the promotion.
  3. One entry per person will be accepted. All duplicate entries will be removed prior to the draw.
  4. The draw for Giveaway Incentives will be conducted on 13th December, 2010.
  5. To be in the running for a Giveaway Incentive, participants must be subscribers of Broadcast Builder and answer 70% or more of the online quiz questions correctly. Entries are automatically submitted when the test is completed with 70% or more correct and when the evaluation forms and registration details are completed online.
  6. If the winner of a prize is under the age of 18 years the prize will be awarded to the prize winner's parent or legal guardian.
  7. The winner will be notified by telephone or email and will be published in the Win a Prize section of the Promoter's website.
  8. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that, is not submitted in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winners entry is of a type described in this clause.
  9. Entries open 13th September, 2010 and must be received by 23:59 (AEST) 12th December, 2010. The time of entry will be the time the online entry is received by the Promoter database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason. Entries will be drawn at 118 Milson Road Cremorne Point.
  10. The entries will be drawn at 10:00 (AEST) 13th December, 2010, the day after entries have been received.
  11. Prizes consist of one Makita Circular Saw to the value of $300 . Only one prize can be awarded.
    The prize will be awarded to the first entry drawn.
  12. All prizes include the cost of delivery to the winners.
  13. Prizes cannot be transferred or be redeemed for cash.
  14. Insurance and warranty for the products will be the responsibility of the vendor suppliers of the prize. Warranty details for each of the components of the prize will be provided with the prize.
  15. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. Once prizes have left Promoters premises, the Promoter will not be responsible for any delay in delivery, or failure of safe delivery of prizes.
  16. The Promoters decision in relation to any aspect of this promotion is final and binding and no correspondence will be entered into. The Promoter reserves the right to verify the validity of claims and entries
  17. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
  18. In consideration for Promoter awarding the prize to the winner, the winner hereby permits their name and photo to appear in connection with the Promoter and with any of their marketing material including but not limited to the website www.broadcastbuilder.com.au/winaprize and the winner will not be entitled to any fee for such use.
  19. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  20. Should an entrants contact details change during the promotional period, it is the entrant's responsibility to notify Promoter at info@broadcastbuilder.com.au with a request to access or modify the information provided in an entry.
  21. Subject to any written direction given under regulation 37 of the Lotteries and Gaming Act 1993 (SA), the promoter may conduct further draws at the same time and place as the original draw as necessary to distribute the prize. The winner will be notified by telephone or email and published within the Win a Prize section of this website.
  22. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
  23. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
  24. The Promoter reserves the right in its sole discretion to disqualify any individual who they have reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  25. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
  26. In entering this promotion, you assume the risks and responsibilities for any loss, damage or consequence arising directly or indirectly from viruses, damage or other defects.
  27. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information, except for the publication of your name and photograph on marketing material and the Promoter’s website without notice and without any fee being paid will be made without prior consent.
