Safety Legislation

Each State and Territory in Australia have their own workplace safety authority and legislation:

  • Australian Capital Territory ( ACT )

    The organisation in charge of workplace safety in the ACT is called WorkSafe. It is a new organisation formed in May 2010 to streamline the way workplace safety is implemented, monitored and investigated in the ACT.

    A new website is under construction. It will be a one stop shop for information related to workplace safety in the Territory.

    If your require more information about OHS legislation in the short term, the Office of Regulatory Services has a WorkCover/WorkSafe section on their website.


  • New South Wales ( NSW )


    The WorkCover Authority of NSW are in charge of implementing work health and safety, injury management, return to work and workers compensation laws in NSW.

    They also manage the NSW workers compensation system, licensing and registration of high risk activities and oversee return to employment of injured workers.

    All legislation related to these activities can be found on their website along with easy to read guides and information that can assist employers and employees to follow workplace safety regulations in NSW

  • Victoria

    The workplace safety authority in Victoria is WorkSafe Victoria


    WorkSafe Victoria enforces occupational health and safety legislation in Victoria, provide injury insurance for employers, help injured get back to work and manage the workers compensation scheme.


    The WorkSafe website is a one stop shop for legislation, guides for safe work practices and valuable resources for students, employees and employers.


  • South Australia

    SafeWork SA administers (implements) occupational health, workplace safe, welfare and some industrial relations laws in South Australia.

    WorkCover SA looks after manages the Workers Rehabilitation Compensation Scheme in South Australia.


  • Western Australia

    WorkSafe WA is the government agency responsible for implementing occupational health and safety legislation in Western Australia. Their website is part of the Department of Commerce website.


    The Occupational Safety and Health Act 1984 is the name of the legislation that aims to promote and achieve safe workplaces for Western Australian people.

    WorkCover WA is the government agency responsible for implementing the workers' compensation and injury management system in Western Australia. Their website includes links to legislation, fact sheets for employees, employers and health care providers, dispute resolution services and guidelines for insurance.


  • Tasmania

    Workplace Standards Tasmania is the government department that oversees the development and implementation of occupational health and safety legislation in Tasmania. This means that they promote safety in the workplace and ensure compliance with legislation.


    Workplace Standards Tasmania has a Safety and Compliance section on their website that provides links to occupational health and safety legislation and resources and tools to assist employers and employees to implement the legislation and understand their rights and responsibilities.

    Workers compensation and injury management legislation is administered and implemented by a different government agency. WorkCover Tasmania

  • Northern Territory - coming soon
  • Queensland - coming soon

A lot of work is being done to harmonise Australia's work, health safety legislation to streamline the legislation and minimise the differences that currently exist between States and Territories. This is being carried out by Safe Work Australia. A national approach will decrease many costs and confusion associated with workplace safety for business that work across State borders. We will keep up up to date about these changes in our eNews.

Rights and responsibilities


  • Employers and employees have specific rights and responsibilities related to safety at work.

  • Each State and Territory in Australia details the safety rights and responsibilities of employers and employees in their Acts, Regulations and Codes of Practice.

Dial Before You Dig resources

 

Dial Before You Dig is a free national service that helps people who are involved in excavation (digging) work identify the location of underground infrastructure (pipes and cables) before they commence work.

It is a fast and easy service that helps:

  1. Owners of underground services such as Telstra protect their pipes and cables and minimise disruptions to service from accidental damage by people doing excavation work

  2. People doing excavation work to avoid costly mistakes, serious injuries and even death as a result of accidently striking underground infrastructure
